​​​​​​School district certified liability insurance guidance​​

KRS 160.105 requires the Kentucky Board of Education (KBE) to promulgate a regulation requiring each school district to provide each certified employee of the district with primary liability insurance coverage for an amount of not less than one million dollars for the protection of the employee from liability arising in the course and scope of pursuing the duties of employment. 702 KAR 3:330 requires each school district beginning with the 2024- 2025 school year to provide each certified district employee with primary liability insurance coverage in an amount not less than one million for the protection of the employee from liability arising in the course and scope of pursuing the duties of his or her employment. 702 KAR 3:330 also requires school districts to annually report information to the Kentucky Department of Education (KDE) related to their primary liability insurance policy and requires school districts to immediately notify KDE if their primary insurance policy is cancelled during the policy term. If the primary liability insurance policy is cancelled during the policy term, the school district must procure alternative liability insurance coverage and provide notification to KDE related to the replacement liability insurance coverage.

KRS 161.212 establishes the Educators Employment Liability Insurance Program which provides employment liability insurance for all Kentucky public school certified employees for judgements or settlements that are in excess of the coverage provided in KRS 160.105. KRS 161.212 requires KDE to enter into a contract to provide excess liability coverage to the coverage required in KRS 160.105​ for an additional amount of not less than one million per occurrence and three million aggregate for each certified employee. KDE has entered into a contract with AssuredPartners NL, LLC for the excess liability coverage.

The Insurance Guide ​is designed to provide Kentucky school districts with general guidance on insurance requirements, including applicable laws, regulations, and best practice recommendations from the Kentucky Department of Education (KDE). The information presented is intended for reference purposes only. KDE's recommendations are offered as supplemental guidance to help districts comply with statutory and regulatory obligations.​
