The Kentucky General Assembly passed House Bill 563 (HB 563) during the 2021 Regular Session and it became law on June 29, 2021. Per KRS 157.350(4)(b), nonresident pupils admitted pursuant to district nonresident pupil policies adopted under KRS 158.120 may be included in average daily attendance (ADA) for SEEK eligibility without a written agreement with the pupils' resident districts. KDE has issued guidance on HB 563.
The Non-Resident Student report aggregates the number of non-resident students attending each district and aggregates the number of non-resident students leaving each district.
KRS 158.120 requires districts to file a copy of their nonresident pupil policy and any subsequent changes with the Kentucky Department of Education (KDE) no later than thirty days following their adoption. Below are the policies received by KDE. To ensure you are viewing the most recent policy adopted by the local board of education, please contact the school district.
Below, you will find the policies listed for each district. If a district is not listed below, the Kentucky Department of Education has not yet received a Non-Resident Policy for that district.
