The department's major activities include:- Administering the statewide assessment and accountability system;
- Providing technical assistance to schools and districts in the areas of finance, management and curriculum;
- Providing support and information to the Kentucky Board of Education as it promulgates state education regulations;
- Overseeing the state education technology system;
- Monitoring school and district compliance with state and federal laws.
- Providing instructional services to students at Kentucky School for the Blind, Kentucky School for the Deaf and the Area Technology Centers.
Responsibilities include but are not limited to the following:
Provide legal and policy services for the Kentucky Department of Education and the Education Professional Standards Board.
Provide legal counsel to the Office of Educator Licensure and Effectiveness and the Education Professional Standards Board (EPSB).
Appear at meetings of the EPSB, including closed session meetings, to advise the board regarding applicable law and past precedent. Draft final orders of the EPSB and ensure compliance with KRS Ch 13B.
Conduct in-depth research and analysis, including legal and policy analysis, to thoroughly inform the Associate Commissioner and General Counsel regarding the education policy landscape, policy options, and potential impacts.
Draft proposed legislation and administrative regulations based on policy research, applicable law, and agency policy position.
Meet with and clearly communicate to various stakeholders (including but not limited to the agency cross-functional teams, Kentucky Board of Education and/or Education Professional Standards Board, legislators, legislative review committees, school district representatives, and agency advisory groups) the proposed legislation or administrative regulation, including how the proposal impacts the current education policy landscape and potential impacts.
Ensure timely filing and maintenance of administrative regulations in accordance with KRS Ch 13A.
Timely track and thoroughly analyze the impacts of all proposed state and federal laws/regulations impacting the office, agency, and/or EPSB.
Ensure the Associate Commissioner and General Counsel are timely informed of the proposed law/regulation and potential impacts.
Timely and effectively communicate with agency cross-functional teams the proposed state and federal law/regulation to gather feedback regarding impacts to other agency offices.
Draft thorough and timely technical assistance documents explaining new or existing statutes and administrative regulations, tailored to the needs of the target audience.
Timely and effectively communicate with agency cross-functional teams the technical assistance documents and current policy position to ensure uniform understanding, and to gather feedback regarding impacts to other agency offices.
Timely and effectively communicate with intra office staff the technical assistance documents and current policy position to ensure uniform understanding and operations.
Meet with and clearly communicate with various stakeholders (including but not limited to the agency cross-functional teams, Kentucky Board of Education and/or Education Professional Standards Board, legislators, legislative review committees, school district representatives, and agency advisory groups) the technical assistance documents and agency policy positions.
Assist in coordinating the virtual and in-person meetings of the Education Professional Standards Board including communication with the members, development and review of the agenda and agenda book, and ensure all meeting notices are published.
Develop and present accurate and thorough information, both in writing and verbally, regarding EPSB governing statutes, regulations, and board procedures, as well as other relevant education law and guidance, for education stakeholders, KDE staff, and the public.
Maintain exceptional written and verbal communication skills for all forms of communication.
Foster an environment of teamwork through coaching, mentoring, providing, and accepting constructive feedback, demonstrating willingness to help all members of the team, and a commitment to success of the agency.
Assist supervisor(s) in the review, design, and implementation of procedures for improving the efficiency of the EPSB and Office of Legal Services.
Prepare and present educational workshops to stakeholders, either in person or electronically, regarding the work of the EPSB.

EXPERIENCE, TRAINING OR SKILLS:
Must have five years of experience as a licensed attorney in the practice of law. Substantial experience in the areas of education law, administrative hearings, and professional licensure is preferred.

The Kentucky Department of Education is a service agency of the Commonwealth of Kentucky, and part of the Education and Workforce Development Cabinet. The department provides resources and guidance to Kentucky's public schools and districts as they implement the state's P-12 education requirements. The department also serves as the state liaison for federal education requirements and funding opportunities.
The department is led by an appointed commissioner of education, who is hired by and answers to the 11-member Kentucky Board of Education. Offices are administered by associate commissioners and divisions within those offices are administered by division directors.
The department employs approximately 425 Frankfort-based workers; 175 employees in support of the Kentucky School for the Blind (Jefferson County) and Kentucky School for the Deaf (Boyle County); and about 518 employees at the 50 Area Technology Centers across the state.
