Accessibility statute (KRS 156.027) and regulation (704 KAR 3:455) went into effect July 2003 and impacts the 2004 and subsequent adoption cycles. While KDE's goal is accessible textbooks and instructional materials for students with disabilities, KRS 156.027 and 704 KAR 3:455 do not directly impact the 2003-08 Mathematics adoption cycle. Although Reading First is not part of the textbook adoption cycle, accessibility requirements of KRS 156.027 and 704 KAR 3:455 do apply to instructional materials purchased with Reading First funds.
For Publishers and Educators:
Recent passage of the Individuals with Disabilities Education Act (IDEA) in November 2004 requires the adoption of NIMAS (national standard) for accessible materials. This requirement will not go into effect until 2006. In accordance with accessibility statute (KRS 156.027) and regulation (704 KAR 3:455), Kentucky's accessibility requirements will continue until legislative changes reflect a need for change. XML files using the NIMAS tag set for textual content will generally meet Kentucky's Level 1 requirement as long as images are supplied and an accompanying style sheet is included that provides for the creation of a student ready electronic version which is comparable to the print version.
